The U.S. Supreme Court, in a 2002 decision in a case called Atkins, exempted all mentally ill offenders from execution, in part because those who struggle with impulse control, for example, are less culpable for their crimes. But also because mentally ill offenders may be especially vulnerable to wrongful convictions since they’re less able to help attorneys build strong defenses.

Wilson is a textbook example. According to his attorneys’ brief, Wilson was fingered as the lead shooter by a more sophisticated accomplice, and evidence of his “confession” in the murder of police informant Jerry Williams came from the accomplice’s wife.

The lawyer for a Beaumont man scheduled for execution tonight plans to file a last-minute appeal in the Texas Court of Criminal Appeals, asking judges to review DNA found at the scene of a 1992 crime that put Marvin Lee Wilson on death row.

Wilson, 54, was convicted in 1994 of kidnapping and killing 21-year-old Jerry Robert Williams, a confidential Beaumont Police Department informant.

At a hearing last month in District Judge Larry Gist’s court, Benny Frank Nettles, a man who claimed he was a longtime friend of Wilson’s, said another one of his friends admitted to killing Williams in 1992.

Gist said the new evidence did not establish a “reasonable probability” that the outcome of Wilson’s trial would have been different had the evidence been presented at the time.

Kovarsky said Wilson’s defense investigated that claim, and said they believe there is basis for DNA found at the scene to be tested again.

In the interview, Wilson discussed the DNA, fervently describing a hair investigators found between Williams’ fingers when they discovered his body. The hair belonged to a white person, he said.
